Judge in Roeder case clarifies legal ruling
Judge Warren Wilbert reiterated points he made in a pre-trial motion hearing last Friday, that defendant Scott Roeder will not be able to use the so-called "Necessity Defense" in his trial over the murder of Dr. George Tiller." Wilbert said however, that he can't rule on whether or not the jury can consider voluntary manslaughter until evidence has been presented.
